PetDeets Terms of Service

Effective Date: August 2, 2026 Last Updated: August 2, 2026

1. Agreement to Terms

These Terms of Service (the "Terms") form a binding agreement between you ("you," "your," or "User") and Stinky Software LLC, an Oregon limited liability company ("PetDeets," "we," "us," or "our"), governing your access to and use of the PetDeets mobile applications, website at petdeets.com, application programming interfaces, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years of age to create an account. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. The Service is not directed to children under 13, and we do not knowingly collect personal information from them.

By using the Service, you represent that: (a) you meet the age requirement; (b) you have the legal capacity to enter into this agreement; (c) you are not barred from using the Service under the laws of your jurisdiction; and (d) all information you provide is accurate and current.

3. Description of the Service

PetDeets is a record-keeping and organizational tool that allows you to store, organize, and share information about your animals, including medications, feeding schedules, medical history, allergies, behavioral notes, care instructions, documents, and photographs. The Service may also provide optional reminders, notifications, and sharing features that let you grant limited access to caregivers, sitters, walkers, boarding facilities, or veterinary professionals.

We may add, modify, suspend, or discontinue any feature at any time. Where a change materially and adversely affects a paid feature you are actively using, we will provide reasonable advance notice as described in Section 20.

4. NOT VETERINARY OR MEDICAL ADVICE

4.1 Record-keeping only. The Service is an informational record-keeping tool. It does not provide veterinary, medical, nutritional, behavioral, or emergency advice, diagnosis, or treatment, and it is not a substitute for professional veterinary care. No veterinarian-client-patient relationship is created by your use of the Service.

4.2 Your judgment governs. You are solely responsible for the health, safety, and welfare of your animals and for all decisions regarding their care. Always consult a licensed veterinarian regarding any health concern. In an emergency, contact a veterinarian or emergency animal hospital immediately — do not rely on the Service.

4.3 Accuracy of content. Any dosing information, schedules, intervals, weights, unit conversions, breed information, or other data displayed by the Service originates from you, from a person you have authorized, or from third-party sources. We do not verify, validate, or clinically review this information. You are responsible for confirming that any information you record or rely upon is accurate and appropriate for your animal.

4.4 Document scanning and extraction. Where the Service offers automated extraction of information from uploaded documents (for example, veterinary records), such extraction is performed by automated systems, may contain errors or omissions, and is provided for convenience only. You must independently verify all extracted information against the source document before relying on it.

5. REMINDERS AND NOTIFICATIONS — NO GUARANTEE OF DELIVERY

THIS SECTION IS IMPORTANT. PLEASE READ IT CAREFULLY.

5.1 Best-effort delivery. Reminders, alerts, push notifications, and any other time-based features are provided on a best-effort basis only. Delivery depends on systems and conditions outside our control, including without limitation: your device settings, operating system behavior, notification permissions, battery-saving and focus modes, application state, network and cellular availability, third-party push notification services (including Apple Push Notification service and Google Firebase Cloud Messaging), SMS carriers and gateways, and our own hosting infrastructure.

5.2 No reliance for critical care. You must not rely on the Service as the sole or primary mechanism for administering time-sensitive or life-sustaining care, including but not limited to medication, insulin, seizure medication, or other critical treatments. You are responsible for maintaining independent means of ensuring such care is delivered on schedule.

5.3 No warranty of timeliness. We do not warrant that any reminder or notification will be delivered, delivered on time, delivered to all of your devices, or delivered at all. Missed, delayed, duplicated, or failed notifications do not constitute a breach of these Terms.

6. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to: (a) provide accurate registration information; (b) keep your credentials secure and not share them; (c) notify us promptly at [email protected] of any unauthorized access or suspected breach; and (d) be responsible for the acts and omissions of anyone you permit to access your account.

We may suspend or terminate accounts that we reasonably believe have been compromised, are being used in violation of these Terms, or pose a risk to the Service or other users.

7. Subscriptions, Billing, Free Trial, and Cancellation

7.1 Tiers. The Service offers a free tier with limited functionality and a paid subscription ("Subscription"). Current pricing and included features are displayed at the point of purchase and at petdeets.com.

7.2 FREE TRIAL.

PLEASE READ THIS SECTION CAREFULLY. YOUR SUBSCRIPTION WILL BEGIN AND YOU WILL BE CHARGED AUTOMATICALLY WHEN THE FREE TRIAL ENDS UNLESS YOU CANCEL FIRST.

(a) What the trial is. New subscribers are eligible for a fourteen (14) day free trial. During the trial you have full access to paid features at no charge.

(b) Who is eligible. The free trial is available to first-time subscribers only, and is limited to one trial per account. If you have previously started or used a free trial on your account — on any platform — you are not eligible for another, and your Subscription will be charged immediately upon purchase with no trial period.

(c) What happens at the end. Unless you cancel before the trial ends, the trial automatically converts to a paid Subscription and the payment method on file will be charged the then-current price for the billing period you selected. The Subscription then renews automatically as described in Section 7.3.

(d) How to cancel during the trial. You may cancel at any time before the trial ends and you will not be charged.

(e) Trial length and eligibility are determined at the time of purchase and are displayed to you before you confirm. Where an offer differs from the terms above, the terms displayed at the point of purchase govern.

7.3 Auto-renewal. SUBSCRIPTIONS AUTOMATICALLY RENEW. Unless you cancel before the end of the then-current billing period, your Subscription will automatically renew for a successive period of the same length, and the payment method on file will be charged the then-current renewal price. Billing periods are monthly or annual, as selected at purchase.

7.4 Purchases through Apple. Subscriptions purchased through the Apple App Store are billed by Apple and governed by Apple's terms and your Apple Account settings. Cancellation, refunds, and billing changes for such purchases must be managed through your Apple Account subscription settings; we cannot cancel or refund them on your behalf. Deleting the application does not cancel a Subscription.

7.5 Purchases through our website. Subscriptions purchased directly are processed by our payment processor, Stripe, Inc. We do not receive or store your full payment card details. You authorize us and our processor to charge your payment method on a recurring basis until cancelled.

7.6 Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current paid period. You retain access to paid features through the end of that period. Upon expiration, your account reverts to the free tier; data exceeding free-tier limits may become read-only or inaccessible, but will not be deleted except as described in our Privacy Policy.

7.7 Refunds. Except where required by applicable law or by the platform through which you purchased, fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused features, or periods of non-use. We may, at our sole discretion, offer refunds on a case-by-case basis; doing so does not obligate us to do so in the future.

7.8 Price changes. We may change Subscription pricing. Price changes take effect at the start of your next billing period following at least thirty (30) days' notice sent to your account email address. If you do not agree to a price change, you may cancel before it takes effect.

7.9 Taxes. Prices are exclusive of applicable sales, use, VAT, or similar taxes, which will be added where required.

7.10 Free tier. The free tier is provided as-is, may be modified or discontinued at any time, and carries no service commitment of any kind.

8. Your Content

8.1 Ownership. You retain all ownership rights in the text, photographs, documents, records, and other materials you upload or create through the Service ("Your Content"). We claim no ownership in Your Content.

8.2 License to operate the Service. You grant us a worldwide, non-exclusive, royalty-free, sublicensable (solely to our hosting and infrastructure providers) license to host, store, reproduce, transmit, display, and adapt Your Content solely to the extent necessary to operate, maintain, secure, back up, and improve the Service and to provide it to you and to those you have authorized. This license terminates when you delete Your Content or close your account, subject to reasonable backup retention periods described in our Privacy Policy.

8.3 No use for third-party marketing or model training. We do not sell Your Content. We do not use Your Content to train third-party artificial intelligence models.

8.4 Your responsibilities. You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not infringe any third party's rights or violate any law. Do not upload records belonging to another person's animal without their permission.

8.5 Backups and export. While we maintain backups as a matter of operational practice, you are responsible for maintaining your own copies of any information important to you.

The Service provides an account data export that returns your account information, pet records, and document metadata in a structured, machine-readable format.

We are not liable for loss or corruption of Your Content.

9. Sharing and Authorized Users

The Service allows you to share access to records with other people ("Authorized Users"), such as sitters, walkers, family members, or veterinary staff. You acknowledge that:

(a) you are solely responsible for deciding whom to grant access to and at what level; (b) an Authorized User may be able to view, and depending on permissions modify, add to, or export the records you share; (c) we cannot control what an Authorized User does with information after they have accessed it; (d) revoking access does not retrieve information already viewed, copied, or downloaded; and (e) you are responsible for promptly revoking access when it is no longer appropriate.

10. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) upload malicious code or interfere with the operation, security, or integrity of the Service; (c) attempt to gain unauthorized access to any account, system, or data; (d) scrape, crawl, harvest, or systematically extract data from the Service by automated means; (e) reverse engineer, decompile, or disassemble any part of the Service except to the extent such restriction is prohibited by law; (f) resell, sublicense, or commercially exploit the Service without our written permission; (g) upload content that is unlawful, defamatory, harassing, or infringing; (h) impersonate any person or misrepresent your affiliation; (i) circumvent usage limits, rate limits, or access controls; or (j) use the Service to store information other than that reasonably related to the care of animals.

We may investigate and take any action we deem appropriate for a violation, including removing content, suspending or terminating accounts, and cooperating with law enforcement.

11. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the "PetDeets" name and marks, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use and for the professional care of animals in your custody. No other rights are granted.

The Service may contain links to third-party websites, products, or services. We do not control and are not responsible for third-party content, policies, or practices, and inclusion of a link does not imply endorsement.

Affiliate disclosure: We participate in affiliate programs, including the Amazon Services LLC Associates Program. We may earn a commission on qualifying purchases made through links in the Service, at no additional cost to you. Such links do not constitute a recommendation of any product for your animal, and you should consult your veterinarian before changing any aspect of your animal's diet, medication, or care.

13. Beta Features and Pre-Release Software

We may make features available on a beta, preview, or test basis ("Beta Features"), including through TestFlight or similar programs. Beta Features are provided as-is and as-available, may be incomplete or unstable, may change or be withdrawn without notice, and may result in data loss. Beta Features are excluded from any service commitment and are used entirely at your own risk. You agree to keep non-public information about Beta Features confidential.

14. Termination

14.1 By you. You may stop using the Service and delete your account at any time through the account settings or by contacting [email protected].

14.2 By us. We may suspend or terminate your access, with or without notice, if: (a) you materially breach these Terms; (b) your use creates a legal, security, or operational risk; (c) we are required to do so by law; or (d) we discontinue the Service. Where practicable and lawful, we will provide advance notice and a reasonable opportunity to export Your Content.

14.3 Effect. Upon termination, your license to use the Service ends immediately. Deletion of your data is handled as described in our Privacy Policy, which provides for erasure within thirty (30) days except where retention is required by law. Sections 4, 5, 8.1, 8.5, 11, 15, 16, 17, 18, 19, and 21 survive termination.

15. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) ANY REMINDER OR NOTIFICATION WILL BE DELIVERED OR DELIVERED ON TIME; (c) DATA WILL BE PRESERVED WITHOUT LOSS OR CORRUPTION; (d) ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (e) DEFECTS WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the minimum extent permitted by law.

16. LIMITATION OF LIABILITY

16.1 Exclusion of certain damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PETDEETS, ITS OFFICERS, MEMBERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR FOR ANY VETERINARY OR OTHER COSTS, INJURY TO OR ILLNESS OR DEATH OF ANY ANIMAL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16.2 Aggregate cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (a) THE TOTAL AMOUNT YOU ACTUALLY PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (b) FIFTY U.S. DOLLARS (US$50.00).

16.3 Basis of the bargain. You acknowledge that the limitations in this Section and in Section 15 are an essential basis of the bargain between us, that we would not provide the Service on the pricing offered without them, and that they apply even if a limited remedy fails of its essential purpose.

16.4 Exceptions. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or willful misconduct. If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protection rules, you retain all rights granted to you by those rules, and the limitations above apply only to the extent permitted.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not fully apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless PetDeets and its officers, members, directors, employees, contractors, agents, suppliers, and licensors from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or relating to:

(a) your use of or access to the Service, including any use by anyone accessing the Service through your account; (b) Your Content, including any claim that it infringes, misappropriates, or violates the rights of any third party; (c) your violation of these Terms or of any applicable law or regulation; (d) your violation of the rights of any third party, including any Authorized User or any other animal owner; (e) any decision, act, or omission by you or by any Authorized User relating to the care, treatment, feeding, medication, or handling of any animal; and (f) any claim brought by an Authorized User or other third party relating to information you shared, or failed to share, through the Service.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You will not settle any matter in a way that imposes any obligation or admission on us without our prior written consent. This Section does not require you to indemnify us for our own gross negligence, willful misconduct, or fraud, and applies only to the extent permitted by applicable law.

18. Dispute Resolution

18.1 Informal resolution first. Before filing any claim, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days. We will do the same. Most disputes can be resolved this way, and we would rather fix a problem than argue about it.

18.2 No mandatory arbitration. We do not require you to arbitrate, and we do not ask you to waive your right to participate in a class action. If informal resolution fails, either of us may bring a claim in a court of competent jurisdiction as described in Section 19.

18.3 Small claims. Either party may bring an individual claim in small claims court where the claim qualifies.

19. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Oregon, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and PetDeets agree that the exclusive venue for any action shall be the state and federal courts located in Multnomah County, Oregon, and each party consents to personal jurisdiction there.

Consumer protection carve-out: If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in, or to the benefit of the mandatory consumer protection laws of, your country of residence, nothing in this Section deprives you of that right.

20. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide at least thirty (30) days' notice by email to the address associated with your account and/or by prominent in-app notice before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and may cancel any Subscription; where a material change adversely affects a paid Subscription you have already purchased, you may cancel and receive a pro-rata refund of the unused portion of the then-current term.

Changes required for legal or security reasons may take effect immediately.

21. General

21.1 Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

21.2 Severability. If any provision is held unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force.

21.3 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

21.4 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, on notice to you.

21.5 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, power or internet failures, or failures of third-party service providers.

21.6 Notices. We may provide notice to you by email to the address on your account or by in-app notification. You may send notice to us at [email protected] or 21000 NW Logie Trail Road, Portland, OR 97231, United States.

21.7 Relationship. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship.

21.8 Export and sanctions. You represent that you are not located in, or a national or resident of, any country subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list.

21.9 Headings. Headings are for convenience only and do not affect interpretation.

22. Apple App Store Additional Terms

These terms apply to the extent you obtained the application through the Apple App Store:

(a) These Terms are between you and PetDeets only, not with Apple. Apple is not responsible for the application or its content. (b) Your license to use the application is a non-transferable license to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions — except that the application may also be accessed and used by other accounts associated with you as the purchaser, via Family Sharing or volume purchasing. (c) We, and not Apple, are solely responsible for providing any maintenance and support services for the application, as described in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the application. (d) We, and not Apple, are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in Section 15. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility. (e) Apple is not responsible for addressing any claims by you or a third party relating to the application, including product liability, legal or regulatory non-compliance, or consumer protection claims. (f) Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the application infringes intellectual property rights. (g) You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government prohibited or restricted party list. (h) You must comply with any applicable third-party terms of agreement when using the application — for example, your wireless carrier's data service agreement, and the terms of any third-party service you connect to or access through the Service. (i) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
